Recent Long Term Care Insurance Denials

Kantor & Kantor is one of the few law firms in the State of California with the experience that comes from handling numerous long term care insurance disputes. As a result of interviews with our prospective clients, and law suits we have filed, we are acutely aware of new claim strategies being employed by long term care insurers to deny claims.

For example, we just recently saw a claim strategy being employed by Golden Rule Insurance Company, a subsidiary of United HealthCare.

The Golden Rule Long Term Care Policy states that benefits will be paid for home health care which is provided under the regular supervision of a registered nurse. We believe that requiring supervision of a registered nurse for unskilled care, such as that provided by a home health aide, is contrary to the requirements of the California Insurance Code. We have seen at least three recent instances where Golden Rule has used this criteria to deny a legitimate claim.
