Class Notices Sent to About 3,000 Potential Plaintiffs to Hold Blue Shield of California Accountable

For Immediate Release

March 9, 2020

Class Notices are being sent to individuals who were covered under a Blue Shield of California non-ERISA health plan during the period of September 2, 2007 through December 31, 2015, and were denied authorization or reimbursement for residential treatment of anorexia nervosa or bulimia nervosa on the grounds that their plans did not provide coverage for residential treatment.

On May 23, 2019, the Superior Court for the County of Los Angeles issued an Order holding that “Blue Shield’s residential treatment exclusion violated California’s Mental Health Parity Act as applied to persons suffering from anorexia nervosa or bulimia nervosa.  Blue Shield may not rely on that unlawful exclusion to refuse to reimburse any new or resubmitted claim for medically necessary residential treatment of any class member’s anorexia nervosa or bulimia nervosa.”

“Patients with eating disorders are entitled to all medically necessary treatment, including residential treatment, under the California Parity Act,” said Lisa S. Kantor of Kantor & Kantor.  “Patients with Blue Shield insurance have waited a long time for Blue Shield to comply with state law.  Finally, these patients will be able to submit claims and obtain reimbursement for treatment that Blue Shield should have been covering all along.”

Says Co-Counsel Kathryn Trepinski, of The Law Offices of Kathryn M. Trepinski in Beverly Hills, California: “We are gratified to announce this result after nearly nine years of intense litigation.  Blue Shield now has the opportunity to right its wrong — the unlawful denial of residential treatment for members with eating disorders.  We encourage class members to submit claims so that they receive the policy benefits they deserve.”
